A new consultation has been launched to align the fees for professional and non-professional applicants of probate into a single fee of £273. The Ministry of Justice proposes that this will apply to all sizes of estate from 2022. Estates below £5 000 will remain exempt from the fees. Current fees are £155 for lawyers and £215 for lay people.
The document states that this ‘modest increase’ which is expected to raise an additional £23m to £25m is ‘directly tied to the cost of providing the service’. It aims to achieve three key objectives:
- it removes a now unjustified discrepancy in the way that fees are charged which differs depending on who applies;
- it will eliminate the public subsidy for the probate application process -according to the ministry it costs more to process applications than the fees it receives; and
