The publication of the consultation on the tax treatment of predevelopment costs has been postponed after the Court of Appeal’s recent decision in the case of Orsted West of Duddon Sands (UK) Limited and others v CRC. (See ‘Wind of change’ by Alun Oliver, Taxation, 3 April 2025.)
The government says to give stakeholders and itself ‘time to reflect on the judgment’ and the effect it may have on the consultation, it will determine its next steps in due course.
In the interim, the government welcomes views on the implication the judgment. Comments should be emailed to predevcosts@hmtreasury.gov.uk.
