  • Government’s 2016 proposals for increased probate fees met with outcry and were shelved.
  • New fees have been announced in the House of Commons with no consultation due.
  • Charities may be big losers as a result of the new regime.

In February 2016 the Ministry of Justice revealed a scheme to increase probate fees in England and Wales that would raise an additional £300m a year to fund the courts and tribunals service. This would be achieved through a new sliding scale schedule with fees starting at £300. Estates valued at more than £1m would have paid £8 000 those between £1.6m and £2m £12 000 while for estates worth more than £2m the fee was set to be £20 000.
