Where is a business established – UK or Australia?

I have a client who emigrated to Australia last year and lives in Sydney. He has a profitable activity in the UK buying footballs from wholesalers and selling them from vans at sporting events.

The trading is carried out through a UK incorporated company and all buying and selling takes place in the UK. Annual sales are about £60 000 and the only UK employee deals with the stock handling and selling issues. My client is sole director and shareholder and manages the entire business from the company’s registered office in Sydney.

My first thought was that the company now needs to register for UK VAT as an NETP (non-established taxable person) based in Australia because of the zero registration threshold that applies to NETPs.

However a colleague has said that the business is still classed as a UK business because it was incorporated in the UK and is eligible for...
