The new patent box rules will affect small and medium-sized enterprises

KEY POINTS

  • New patent box rules apply from July 2016
  • The new patent box rules will no longer allow the ‘standard method’ of calculation.
  • The three-stage method of calculating IP profits remains in the new regime.
  • It will be necessary to stream for every individual IP right patented product or product family.
  • If the patent box benefit has been unfairly restricted an alternative calculation may be possible.
  • Grandfathering provisions will apply until 30 June 2021.
