The VAT applicable to a UK company selling and dispatching goods from Poland

We recently started to act on behalf of a new client and have encountered a VAT dilemma.

The client trades through a limited company based and registered in England and Wales. It has voluntarily registered for VAT in the UK although no sales have as yet taken place here. The company produces designer clothing in factories in Poland and China. It then sells the clothes around the world to its customers who are private individuals.

The company makes no business-to-business sales only “B2C”.

Once the order is received the clothes are packed in the company’s warehouse in Poland and then dispatched from there to the final customer who may be in Poland itself the UK another EU country or anywhere in the world.

The company has previously filed an application form to register for VAT in Poland and is awaiting its Polish VAT number.
