A paediatrician has retired from employment and now receives a pension from the National Health Service; he is continuing in private practice

My client is a paediatrician. He has retired from the NHS and is receiving a pension from the NHS pension scheme which puts him into the higher rate tax bracket.

He is continuing with his private practice and has asked me whether he could carry this out through a limited company.

I have always been under the impression that doctors are not permitted to practise through a limited company by the General Medical Council or by their particular professional body.

However having checked with the GMC and the Royal College of Paediatricians it appears that there is no such restriction.

Due to the potential savings in tax and National Insurance contributions practising through a limited company appears to be an attractive option.

My query is given the possible reductions in liability why aren’t more consultants taking this option? Or am I missing something?
