HMRC acted unreasonably in withdrawing status, says firm's owner

The owner of the East Sussex accountancy that last week won a judicial review to overturn HMRC’s withdrawal of tax agent status has said his firm has returned to business as usual.

In an interview with Taxation’s editor, Mike Truman, Christopher Lunn claimed the Revenue will not appeal the decision of the court, which found in favour of his firm, Christopher Lunn & Co, saying the taxman’s actions were procedurally unlawful.

Mr Lunn insisted his employees are entitled to continue to represent taxpayers to HMRC, and it is the department on which the onus of the judgment lies. Filing online is currently an obstacle because it will take time for the taxman to generate and issue a new agent code. Mr Lunn is confident, however, that the matter will be resolved before mid-April.

He said the Revenue acted unreasonably in terminating the tax agent status of his firm, which specialises in clients from the TV industry; he does not know whether or not the department is considering take the measure again.

Nevertheless, he has instructed his members of staff to tell clients that they should consider Christopher Lunn & Co to be an acting agent.

A criminal investigation of the firm by HMRC is ongoing.
