A husband and wife live in different properties, although they have not formally separated and they do holiday together

We have been approached for advice by our client Mrs P on the following scenario and we would appreciate readers’ opinions regarding the two properties owned by her and her husband.

Using funds provided wholly by our client a matrimonial home was purchased in London in the joint names of Mr and Mrs P in June 1966 following their marriage in 1964.

At that time the couple had no other property.

In June 1990 Mr P started a business in Shropshire and purchased a house there in his own name.

The couple are still married and there has been no separation agreement.

It seems that while neither party wishes to formalise a separation from our client’s (the wife’s) side neither is there any current intention to live together although they do holiday together.
