A client continued to claim tax credits for her two children as a single parent, even though she was living with a partner. Is it correct that the Tax Credits Office can recover that amount?

Our new client claimed tax credit as the single carer of two children although she lived with her partner.

She continued to receive tax credits of around £15 000 over two years.

Our client has confirmed with the Tax Credit Office that she had made a mistake in making a single claim and would like to make a joint claim to this benefit in the future.

The Tax Credit Office sent an application form to our client to enable her to make a joint claim but they have also sent a notice requesting repayment of the £15 000 worth of tax credits that had previously been paid to her.

Is there no rule where we can do new calculations for the past two years to include her partner’s income?
