'Valentine Homes victory is pyrrhic'

Valentine Homes & Construction Ltd v HMRC [2010] EWCA Civ 345 is a case about HMRC intransigence and abuse of power (see Reasonable claim).

Valentine Homes were awarded a sum of £6 000 towards meeting the costs of the failure of HMRC to act in accordance with common decency. HMRC harassed a company one of whose directors a Mr Brooke was in hospital in Spain with a serious head injury requiring brain surgery.

His wife Mrs Brooke the mother of their three children with a fourth on the way was at his bedside. She was the company’s other director. Mr Brooke is well known to many of us being the former All Black Mr Zinzan Brooke. He his family and his company were treated disgracefully.
