Pentland-Clark v Wilson and others, Court of Session

The pursuer claimed that her late former husband’s executry estate was being maladministered to the extent that there no funds to pay her monthly maintentance.

This was a lengthy and complicated case, with the executry estate facing bitter litigations over several years.

The Court of Session refused the pursuer’s claim saying that her action did not contain a relevant claim. Furthermore in most cases thater had been no breach of duty by the ddefenders.
