The tax treatment of a distribution to Lloyd's underwriters from Equitas

I have two clients who are retired reinsured Names involved with Equitas. One has since died. Last year they received the long awaited first distribution of about £3 000 each from Equitas; a second and final distribution may be forthcoming if and when novation is achieved. Both Names ceased underwriting at 31 December 1993 and at the end of the usual three year period they had unrelieved Lloyd's losses of thousands of pounds. In subsequent years I have covered sundry Lloyd's income e.g. action group recoveries interest on Lloyd's deposits and members special contribution refunds with the losses by submitting the appropriate Lloyd's self assessment forms which have never been questioned either by the Leeds Underwriters Unit or subsequently by the local Inspectors involved. The last year in which Lloyd's sundry income arose was 2004-05 and still there are unrelieved losses remaining.
