How to deal with an HMRC enquiry into R&D claims.

Enquiries by HMRC into research and development (R&D) claims have increased and so it is important to know how to deal with them. Enquiries can take a number of forms:

  • extra scrutiny on claims before the payment is made (rather than a pay-now-check-later system);
  • challenging claims through opening formal enquiries/compliance checks;
  • using its fraud investigations team to contact companies where claims may have been made incorrectly; and
  • undertaking criminal investigations which can lead to prosecution.

If you or a client receives a letter from HMRC opening an enquiry don’t panic! It is very unlikely that the claimant company has been deliberately targeted.

  • Check that the enquiry is valid. HMRC has between 12-15 months to open a valid enquiry into an R&D claim.
