Guidance on publication of Upper Tribunal decisions

The president of the Upper Tribunal (Tax and Chancery Chamber) has issued guidance on the publication of decisions of that chamber.

The following decisions will be published:

  • final decisions following substantive oral hearings and those refusing permission for judicial review;
  • decisions following any interlocutory oral hearing except for matters of routine case management or decisions on costs applications; and
  • decisions refusing permission to appeal a decision of the First-tier Tribunal or Upper Tribunal where this is made following an oral hearing – this is a change of practice for the Upper Tribunal.

The tribunal will not publish the following:

  • decisions granting permission for judicial review;
  • decisions on interlocutory matters decided on the papers ie without an oral hearing unless the judge considers the matter to be of wider interest;
  • decisions granting permission to appeal a decision of the First-tier Tribunal or Upper Tribunal; and
  • decisions refusing permission to appeal a decision of the First-tier...
