The president of the Upper Tribunal (Tax and Chancery Chamber) has issued guidance on the publication of decisions of that chamber.
The following decisions will be published:
- final decisions following substantive oral hearings and those refusing permission for judicial review;
- decisions following any interlocutory oral hearing except for matters of routine case management or decisions on costs applications; and
- decisions refusing permission to appeal a decision of the First-tier Tribunal or Upper Tribunal where this is made following an oral hearing – this is a change of practice for the Upper Tribunal.
The tribunal will not publish the following:
- decisions granting permission for judicial review;
- decisions on interlocutory matters decided on the papers ie without an oral hearing unless the judge considers the matter to be of wider interest;
- decisions granting permission to appeal a decision of the First-tier Tribunal or Upper Tribunal; and
- decisions refusing permission to appeal a decision of the First-tier...
