European Commission to appeal Apple decision

The European Commission has decided to appeal against the ruling by the EU general court that Apple does not have to repay €13m tax to Ireland. The court disagreed with the commission that the company had been granted illegal state aid through selective tax breaks.

EU executive vice president Margrethe Vestager said: The General Court judgment raises important legal issues that are of relevance to the commission in its application of state aid rules to tax planning cases. Making sure that all companies, big and small, pay their fair share of tax remains a top priority. If member states give certain multinational companies tax advantages not available to their rivals, this harms fair competition in the EU in breach of state aid rules.

‘We need to continue our efforts to put in place the right legislation to address loopholes and ensure transparency.’

The appeal will be heard in the European Court of Justice.
