  • Should taxpayers be penalised if HMRC considers they knew or should have known that their transactions were connected with fraud? Consider letting HMRC know your views by responding to the consultation.
  • The taxpayer’s understated income in Scott (TC5335) was found by the First-tier Tribunal to be the result of a disorganised approach to maintaining records. Make sure that your clients are aware of the importance of keeping accurate records and maintaining documentary evidence.
  • Rebasing of foreign assets is available only to individuals who become deemed domiciled in April 2017 but they must have paid the remittance basis charge for 2016-17 to qualify. Consider whether any clients might wish to pay the charge so that they can take advantage of the rebasing opportunity.
