In stark contrast to the stance taken by HMRC in respect of tax returns delayed by the current Royal Mail industrial action, Companies House has issued a notice in which it says:
‘Where documents are subject to statutory time limits, it is the legal responsibility of company directors to ensure that they are delivered to the registrar on time. The fact that the documents are in the post or that there is a postal strike is not an acceptable excuse for late delivery.’
The notice suggests that individuals use Companies House webfiling or software filing services to file information electronically.
A security and authentication code is required to use the webfiling service, so anyone who is not already registered is advised to ‘allow plenty of time in which to receive these codes’.
Companies House also says that couriers can be used, or documents can be delivered by hand to offices in Cardiff, London, Edinburgh and Belfast.
While Companies House ‘can consider extending the filing time in exceptional circumstances, any extension request must be received by the filing deadline’.
