The wife of a plumber lets a property that has suffered water damage. The insurance company has made a substantial payment to her based upon an invoice tendered by her husband, though not in the name of his normal business.

My client Mr A is a plumber. His wife owns a let property that recently suffered significant damage as the result of a failure within the water system for which she made a claim upon her property insurance.

Mr A quoted £14 400 to undertake the work. He did not submit the quote on his normal plumbing trade letterhead but rather on a letterhead devised for the purpose and bearing the description ‘A N Other Project Management’.

His tender was successful. It is understood that the loss adjuster did not seek other tenders presumably being satisfied as to the reasonableness of the quote.

The bulk of the materials were paid for from Mr A’s private bank account. He did most of the work himself with the unpaid assistance of a couple of friends and paid one or two other tradesmen in cash from private resources.
