My client purchased a redundant gravel quarry some years ago. Since that time, he has been trying to obtain planning permission to fill the quarry without success, his applications being refused by the local authority.
 Some years ago he came into contact with another local company which was interested in extracting further gravel from the quarry. Due to his lack of funds, he agreed a lease with them on the basis that they would incur all costs in challenging the local authority on the operation of the site.

After successful applications through the High Court the company was successful in reinstating the extraction rights on the quarry.
