I do not dissent from the reservations expressed by Peter Vaines Taxation 28 October 2004 page 104 about the approach of Dr Brice in Jones v Garnett. But the Special Commissioner also seems to have overlooked the fact that this particular company was a quasi-partnership. This meant that in the event of the husband failing to operate the company in the manner envisaged the wife could also have applied to the Court under Companies Act 1985 s 459.
