An employment tribunal held in Southampton has ruled that house sitters working for Homematch Ltd are entitled to the national minimum wage.
The house sitters provide a service to homeowners who wish to have someone living in their house while they are away. Homematch Ltd recruits people, vets them and arranges for them to live in the house as a house sitter.
The tribunal concluded that the house sitters were engaged in time work under a worker's contract and entitled to be paid for all the hours they were available for work. The decision confirms that these should include the time when workers were present in the house, except for when they were asleep. The national minimum wage is not due for periods during the day when the house sitters are free to leave the premises.
